The definition of pollutant is broad, typically encompassing any solid, liquid, gaseous, or thermal irritant or contaminant, including smoke, vapor, soot, fumes, acids, alkalis, chemicals, and waste. The absolute pollution exclusion in the ISO CGL form (CG 00 01, Section I, Coverage A, Exclusion f) has been part of the standard policy since 1986 and has been the subject of extensive litigation regarding its scope.

For apartment owners, the practical impact of this exclusion is significant because several common apartment claims involve substances classified as pollutants. Mold is a pollutant under most policy definitions, so mold remediation costs and tenant health claims from mold exposure are excluded. Lead paint dust is a pollutant, so claims from lead exposure (particularly in buildings built before 1978, when the Consumer Product Safety Commission banned lead-based paint under 16 CFR 1303) are excluded. Asbestos fibers, carbon monoxide from faulty heating systems, sewage backups, and fuel oil leaks are all excluded under the pollution exclusion.
